Terms of Service

Version 1.0 · Effective date: To be set on launch

Applies to: Zensus mobile application (iOS, Android) and zensus.co.uk

These Terms are written in English and the English version is the original and legally binding version. Translations, where provided in the app, are for convenience only and generated by DeepL machine translation. In the event of any inconsistency or dispute between a translated version and the English original, the English version shall prevail. These Terms form part of the Zensus legal framework alongside our Privacy Policy, Health Data Agreement, Subscription Terms, Avatar Purchase Terms, Teams Community Guidelines, Focus Group Preferences, and Data Retention Policy. Capitalised terms not defined here have the meaning given to them in those documents.

1. Eligibility and Account Creation

Zensus is provided by ZENSUS LTD, a company registered in England and Wales ("Zensus", "we", "us", "our"). By creating an account, you confirm that:

You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

2. Acceptable Use

You agree not to:

Violations may result in suspension or termination of your account (see Section 9).

3. Intellectual Property

The Zensus App, its design, branding, and original content are owned by ZENSUS LTD and protected by copyright and other intellectual property laws. You may not copy, redistribute, or create derivative works from the App without our written permission.

Where you submit content to the App (translation suggestions, health content votes, or feedback), you grant us a non-exclusive, worldwide, royalty-free licence to use, adapt, and display that content within the App for the purpose it was submitted. Where your translation is later removed from your (deleted) account, an anonymised attribution ("Community Member") may remain, per our Data Retention Policy.

All avatar artwork is owned by Zensus. During the open beta only, some free avatars are based on a real creator's likeness (mostly recipe and cooking-video creators), which the creator licenses to Zensus; they are removed from the App, including from users' collections, when the open beta ends. See our Avatar Purchase Terms for your rights as a purchaser.

AI-generated content. The images and videos in the App, including avatars, are generated using Kling AI, and some images are edited using remove.bg.

4. Health Content Disclaimer

Zensus is not medical advice. Zensus is a nutrition and fitness tracking tool, not a medical device. Nothing in the App — including nutrient totals, fitness scores, progress charts, or any content in the Learn section — constitutes medical advice, a clinical diagnosis, or a treatment recommendation. Always consult a qualified healthcare professional before making significant changes to your diet, exercise routine, or health behaviours. If you are experiencing a medical emergency, contact your local emergency services immediately.

Full detail on how your health data is processed, and the explicit consent this requires, is in our Health Data Agreement.

5. Subscriptions

Zensus offers an optional premium subscription. Subscribing is governed by a separate document, our Subscription Terms, which covers plans, billing, auto-renewal, cancellation, and refunds in full. By subscribing, you agree to both these Terms of Service and the Subscription Terms.

6. Avatars and Virtual Goods

Zensus offers optional avatars as one-time purchases, including free claims via the in-app claim game. Purchasing, owning, and any refund rights over an avatar are governed by our Avatar Purchase Terms, which you agree to in addition to these Terms when you complete a purchase or claim.

7. Teams Feature

Teams are self-selected communities where members choose to share physical performance data with each other and compete on leaderboards. Joining and participating in a Team is available to all users; a Premium subscription is not required. Joining a Team is governed by our Teams Community Guidelines, which cover what data is shared, prohibited content, and how Teams self-moderate (including member voting and removal). By joining a Team, you agree to those Guidelines in addition to these Terms.

8. Sponsorship and Creator Content

Zensus has infrastructure to support sponsored placements from brand partners. As of the effective date of these Terms, no sponsor placements are live.

During the open beta only, some avatars are based on the likeness of a real creator — mostly recipe and cooking-video creators. Creator avatars are always free, are credited in the App to the creator by name, handle and (for cooking creators) the food styles they cook, and are removed from the App for everyone when the open beta ends. No creator is paid for, or receives any share of, anything sold in the App. After the open beta, every avatar is Zensus's own.

9. Suspension and Termination

We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or misuse the service. You may delete your account at any time from Account Settings; see our Data Retention Policy for what happens to your data on deletion.

10. Limitation of Liability

To the fullest extent permitted by law, ZENSUS LTD is not liable for any indirect, incidental, or consequential damages arising from your use of the App, including reliance on health content, translated content, or third-party payment processing. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or fraud.

11. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms will first be addressed through good-faith negotiation by contacting support@zensus.co.uk. If unresolved, the courts of England and Wales will have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and/or an in-app notice, and update the "Effective date" above. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
