Governing language. This document is written in English and the English version is the original and legally binding version. In the event of any inconsistency or dispute between a translated version and the English original, the English version shall prevail.
1. What These Terms Cover
These Avatar Purchase Terms ("Terms") govern the purchase, acquisition, and use of avatar cosmetic items ("Avatars") within the Zensus application ("App"). By completing a purchase or claiming a free Avatar, you agree to these Terms in addition to our Terms of Service and Privacy Policy.
Avatars are digital cosmetic items that customise your in-app profile representation. They confer no real-world value, are not transferable to other users, and are not redeemable for cash or any other currency.
2. Purchasing an Avatar
2.1 Paid Avatars
Avatars available for purchase are priced in your local currency as displayed at checkout. Prices may vary by region. The price shown at the point of purchase is the price you will be charged.
Payments are processed by one of the following providers depending on your region and platform:
- Stripe — web checkout (selected regions)
- Flutterwave — web checkout (selected regions)
- Xendit — web checkout (selected regions)
- Apple In-App Purchase — iOS App Store
- Google Play Billing — Android (Google Play)
- Samsung IAP — Android (Samsung Galaxy Store)
- Huawei IAP — Android (Huawei AppGallery)
- Xiaomi IAP — Android (Xiaomi GetApps)
Your purchase is with Zensus. For platform-billed purchases (Apple, Google, Samsung, Huawei, Xiaomi), payment is collected by the respective platform on our behalf under that platform's terms.
2.2 Free Avatars — Claim Game
Certain Avatars are designated as "free" and can be claimed without payment through the in-app claim game. Each free Avatar displays its win probability in the store (for example, 33% or 0.1%). You are entitled to a maximum of 3 claim attempts per hour.
A claim attempt does not guarantee receipt of the Avatar. The outcome is determined by the displayed probability at the time of the attempt. Unused attempts do not carry over between hour windows and have no monetary value.
2.3 Subscriber-Only Avatars
Some Avatars are designated as subscriber-only. These Avatars:
- Are visible in the store to all users but are locked for non-subscribers
- Require an active Zensus Premium subscription to claim or purchase
- A premium subscription is verified at the point of checkout; non-subscribers cannot complete the purchase
- If your Premium subscription lapses, paid subscriber-only Avatars you bought stay in your collection and you can keep using them — you bought them outright
- If your Premium subscription lapses, free subscriber-only Avatars you claimed stay in your collection but cannot be equipped until your subscription is reactivated; reactivating restores equip access immediately
- During the open beta, every user has Premium access without a subscription (Subscription Terms section 4.4), so any user can get and equip subscriber-only Avatars. When the beta ends, the rules above apply: you need an active Premium subscription to get subscriber-only Avatars and to equip the free ones you already have; paid ones you bought stay usable
2.4 Limited Edition Avatars
Some Avatars have a limited supply. When the supply is exhausted, the Avatar is removed from the store and cannot be purchased. In the rare event that an Avatar sells out while your payment is being processed (a race condition between simultaneous buyers), the Avatar will not be delivered to your account. In that case, the non-delivery exception in Section 5.1 applies and you will be refunded. No "sold out" Avatar will be delivered after the fact.
2.5 Creator Avatars
During the App's open beta only, some Avatars are made by Zensus from the likeness of a real creator — mostly recipe and cooking-video creators. They are credited in the App to that creator by name, handle and (for cooking creators) the food styles they cook.
- Creator Avatars are always free. You claim them through the free claim game, at no cost, and they are never sold, never limited to subscribers and never given away as prizes. No money is paid to or by the creator.
- Creator Avatars exist only during the open beta. When the open beta ends (currently 22 June 2027) — or earlier, if the creator's arrangement with Zensus ends — the Creator Avatar is removed from the App entirely, including from your collection. If you have it equipped, we switch you to one of Zensus's own Avatars you hold, or to the Starter Avatar if you hold no other. Because Creator Avatars are free, there is nothing to refund.
- After the open beta, every Avatar in the App is designed by and belongs to Zensus; no new Creator Avatars are added.
3. Ownership and Licence
Purchasing an Avatar grants you a personal, non-exclusive, non-transferable, revocable licence to use that Avatar within the App for your own account. You do not acquire any intellectual property rights in the Avatar artwork, name, or associated assets.
All intellectual property rights in Avatar artwork remain with Zensus. For Creator Avatars, the creator keeps the rights in their own name and likeness, which they have licensed to Zensus.
4. Avatar Availability
Zensus reserves the right to modify, remove, or discontinue any Avatar from the store at any time. If an Avatar you have already purchased is removed from the store, you retain access to it in your collection for as long as your account remains active. Removal from the store does not entitle you to a refund.
5. Refund Policy
5.1 Web Purchases (Stripe, Flutterwave, Xendit)
Avatar purchases made via web checkout are non-refundable, except in the following circumstances:
- Duplicate charge: If your account was charged more than once for the same Avatar in the same transaction (for example, due to a network error), the duplicate charge will be refunded. Only the duplicate amount is refunded; the original charge is not.
- Non-delivery due to technical failure: If payment was successfully taken but the Avatar was not delivered to your account due to a verified technical error on our side, you are entitled to either delivery of the Avatar or a full refund of that transaction.
By completing a web purchase you acknowledge that, where permitted by applicable law, you waive your right to cancel under consumer distance-selling regulations because digital content is delivered immediately upon purchase. This waiver is recorded at the time of your purchase alongside your explicit consent.
5.2 Platform-Billed Purchases (Apple, Google, Samsung, Huawei, Xiaomi)
For Avatars purchased through a platform's in-app billing system, refund requests must be directed to that platform in accordance with its own refund policy:
- Apple (iOS): reportaproblem.apple.com
- Google Play: Settings → Subscriptions & purchases → Purchase history → Request a refund
- Samsung, Huawei, Xiaomi: Refer to the respective store's help centre
Zensus has no ability to issue or deny refunds for platform-billed transactions. Approved platform refunds may result in the Avatar being removed from your account.
5.3 Fraudulent or Disputed Transactions
If you believe a purchase was made without your authorisation, contact us at support@zensus.co.uk and your payment provider immediately. Do not initiate a chargeback before contacting us — we can resolve most issues faster through our support channel.
6. Consent and Purchase Record
Before completing a web purchase you are required to:
- Acknowledge the no-refund policy described in Section 5.1
- Acknowledge these Avatar Purchase Terms
Both acknowledgements are recorded with your user ID, the Avatar name, the agreed price, currency, and payment provider at the time of purchase. This record is retained as evidence of your informed consent in accordance with applicable consumer protection law.
7. Account Deletion
If you delete your Zensus account, you permanently lose access to all Avatars in your collection, including any Avatars you have purchased. Avatars associated with a deleted account are not transferable and are not eligible for a refund. We recommend equipping or reviewing your Avatar collection before initiating account deletion.
A record of your purchases is retained by Zensus for legal and financial compliance purposes even after your account is deleted, but you will have no access to the Avatars themselves.
8. Statutory Rights
Nothing in these Terms limits any statutory rights you may have under the laws of your country of residence that cannot be excluded by contract. In particular, consumers in the United Kingdom and European Union retain statutory rights under applicable consumer protection legislation to the extent those rights cannot be lawfully excluded.
9. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you in-app and update the version number and effective date above. Continued purchase or use of Avatars after the updated Terms take effect constitutes your acceptance of the changes.
